New Reports and Papers - CONTACT ORDER OR CONTROL ORDER? Looking at the impact of the Family Court process on women who have been affected by domestic violence, from the perspective of advocacy and outreach.

In Family Law matters where domestic violence is prevalent, domestic violence workers have observed that a woman’s safety, and the safety of her children, fail to hold considerable weight in decisions regarding residency and/or contact. In some cases contact orders are made which reflect or perpetuate the control that was exerted over the woman whilst in the domestic violence relationship. It appears that the inherent dangers lie in the current practices of the family law system, which can act to further victimise and traumatise women. Of significant concern is that Family Court Orders are given the jurisdiction to override domestic violence protection orders. Such legal practices put women and children at considerable risk of further harm, or potentially death.
